Waqf Amendment Bill 2024: Reform or Political Flashpoint?

Delhi - The Waqf (Amendment) Bill, 2024, has sparked intense debate across political and religious circles. Touted as a much-needed reform to streamline waqf property management, the bill introduces significant changes, including stricter criteria for declaring waqf, removing "waqf by user," and restructuring Waqf Boards. While the government claims these measures will bring transparency and efficiency, opposition voices fear the bill could erode the autonomy of Waqf Boards and infringe on religious rights.  

 

The provision requiring an individual to practice Islam for at least five years before declaring waqf has drawn particular criticism, raising concerns about undue restrictions on religious donations. Additionally, the removal of "waqf by user" eliminates historical claims to properties used for religious purposes over time, sparking apprehensions about potential land disputes. The bill also proposes a revamped tribunal system and new registration mechanisms, aiming to curb mismanagement and misuse of waqf assets.  

 

The political storm around the bill escalated when opposition MPs were suspended during the Joint Parliamentary Committee’s review process. Heated exchanges and over 500 proposed amendments highlighted the deep divide over the legislation. While supporters argue that the bill will modernize waqf governance and empower marginalized communities, critics warn of excessive government control over religious trusts.
