Waqf Amendment Bill: A Bold Reform or a Threat to Democracy?

Delhi - The controversial Waqf (Amendment) Bill, 2024, has sparked intense debate across the country, with accusations of political overreach and constitutional violations. The Joint Parliamentary Committee (JPC) recently approved the amended bill despite strong opposition, setting the stage for a fierce showdown in Parliament.  

 

Critics argue that the bill fundamentally alters the Waqf Act of 1995, stripping away key protections for waqf properties. One of the most contentious changes is the removal of the "Waqf by user" clause, which previously allowed properties used by the Muslim community for religious purposes to be recognized as waqf land. The opposition fears this could lead to mass dispossession of historic waqf properties.  

 

Another flashpoint is the bill’s provision to include non-Muslims in Waqf Boards. While proponents claim this promotes transparency, opponents see it as an attack on the autonomy of Muslim institutions. Many believe this sets a dangerous precedent that could impact other religious trusts in the future.  

 

The opposition has slammed the government for pushing the bill without adequate consultation. With only a few hours to review a 650-page report, dissenting members argue that the process lacks democratic integrity. Legal challenges are already being considered, and some parties have vowed to fight the bill both inside and outside Parliament.
